What are the rights of the copyright holder?
As the owner of a copyright you have the right to control the use copying and reproduction of that work. You also have the right to create derivative works of that copyright which includes spin-offs and adaptations. Finally you also have the right to distribution which means you can control the means of transferring that copyright and how that's distributed whether it's through licensing rentals or any kind of transfer of ownership
Does a federal trademark registration ever expire?
After you have a federal registered trademark you have to file declaration of use between the fifth and sixth year of registration. Between the ninth and tenth year registration you can file a 10-year renewal for that trademark. Thereafter you can file 10-year renewals for that trademark indefinitely
What can be trademarked?
A trademark is used to distinguish your goods or services from competitors or other people in the marketplace a design a logo a phrase or even a color are all eligible for trademark protection
What kind of damages might I receive if someone infringes upon or uses my trademark?
There are a few different types of damages you may be entitled to for trademark infringement. One is a discouragement of profits if the infringer made money and profits off of the use of your trademark illegally, you may be entitled to those profits. You may also be entitled to actual damages that you incurred as a result of that trademark infringement. Finally you may be entitled to attorney's fees, but those are usually only granted in exceptional cases where the infringer was fraudulent willful or deliberate in their infringement of your trademark.
